One area that is less settled than ever is an employer’s obligations when it comes to LGBTQ discrimination and employee protections. There are so many issues that an employer has to consider. What does the law require at the federal, state, and local levels, and what have the courts and Justice Department said on the topic? Although federal law and Title VII do not prohibit discrimination or harassment based upon sexual orientation or gender identity, many state laws (and even some local laws) do include these protections. How do these different standards work together? Meanwhile, a federal court recently held that sexual orientation discrimination is covered by Title VII, while a recent narrow Supreme Court ruling found for a baker who opted not to make a cake for a gay couple on religious freedom grounds. Given the uncertainty and contradictory rulings and interpretations of the law, it is imperative that you are aware of the current landscape and take appropriate action to identify and reduce potential issues facing both employees and the employer.
